The processing of personal data (e.g. collection, querying, use, storage or transmission) always requires a legal basis and a defined purpose.

Stored personal data will be deleted as soon as the purpose of the processing has been achieved and there are no legitimate reasons for further storage of the data. We inform you in the individual processing operations about the specific storage periods or criteria for storage. Irrespective of this, we store your personal data in individual cases to assert, exercise or defend legal claims and if there are statutory storage obligations.

General information on data processing

In principle, we only collect and use personal data from our users to the extent that this is necessary to provide a functioning website and our content and services. The collection and use of personal data of our users takes place regularly only with the consent of the user. An exception applies in such cases in which it is not possible to obtain prior consent for actual reasons and the processing of the data is permitted by statutory provisions.

Legal basis for processing personal data

As far as we for processing operations of personal data

  • Obtaining the consent of the data subject serves as the legal basis under Article 6(1)(a) GDPR.
  • Article 6 (1) (b) GDPR serves as the legal basis for the processing of personal data required to fulfill a contract to which the data subject is a party. This also applies to processing operations that are necessary to carry out pre-contractual measures.
  • Insofar as processing of personal data is required to fulfill a legal obligation (statutory provisions) to which our company is subject (e.g. federal registration laws), Article 6 (1) (c) GDPR serves as the legal basis.
  • If the processing is necessary to safeguard a legitimate interest of our company or a third party and if the interests, fundamental rights and fundamental freedoms of the person concerned do not outweigh the first interest, Article 6 Paragraph 1 Letter f GDPR serves as the legal basis for the processing.

Data Erasure and Storage Duration

The personal data of the person concerned will be deleted or blocked as soon as the purpose of storage no longer applies. Storage can also take place if this has been provided for by the European or national legislator in EU regulations, laws or other regulations to which the person responsible is subject. The data will also be blocked or deleted if a storage period prescribed by the standards mentioned expires, unless there is a need for further storage of the data for the conclusion or fulfillment of a contract.

Who gets my data?

We only pass on your personal data, which we process on our website, to third parties if this is necessary for the fulfillment of the purpose and is covered in the individual case by the legal basis (e.g. consent or protection of legitimate interests). In addition, we pass on personal data to third parties in individual cases if this serves to assert, exercise or defend legal claims. Possible recipients can then be, for example, law enforcement agencies, lawyers, auditors, courts, etc.

Insofar as we use service providers for the operation of our website who process personal data on our behalf within the scope of order processing in accordance with Art. 28 DSGVO, these can be recipients of your personal data. More information on the use of processors and web services can be found in the overview of the individual processing operations.

Data processing outside the European Union

As far as personal data is processed outside the European Union, you can see this from the previous statements.

EU Standard Contractual Clauses (SCC) are templates provided by the EU Commission and are intended to ensure that your data also comply with European data protection standards if they are transferred to third countries (such as the USA) and stored there. Through these clauses, the service providers undertake to comply with European data protection standards when processing your relevant data, even if the data is stored, processed and managed in the USA. These clauses are based on an implementation decision of the EU Commission. You can find the decision and the corresponding standard contractual clauses here: https://eurlex.europa.eu/eli/dec_impl/2021/914/oj?locale=de .

In both cases, your data will only be stored further if there are statutory storage requirements (e.g. tax and commercial law).

Stripe

We use a payment tool from the American online payment service Stripe for EC payments on our website. Stripe Payments Europe (Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland) is responsible for customers within the EU. This means that if you choose EC payment as your payment method, your payment will be processed via Stripe Payments. Data required for the payment process is forwarded to Stripe and stored. Below we give you an overview of this data processing and storage by Stripe and explain why we use Stripe on our website.

Data may not simply be transferred to unsafe third countries, stored there and processed unless there are suitable guarantees (such as EU standard contractual clauses) between us and the non-European service provider.
